Administrative Review Tribunal (ART) to Replace Administrative Appeals Tribunal (AAT) in October 2024

Overview of the Administrative Review Tribunal (ART) 

The Administrative Review Tribunal (ART) is scheduled to commence operations on 14 October 2024, replacing the Administrative Appeals Tribunal (AAT). This change follows the passage of legislation in May 2024 and its subsequent royal assent in June 2024. The ART is intended to enhance the administrative review process by providing more efficient and effective handling of appeals and reviews. 

 

Key changes and transition process 

All matters currently before the AAT will transition automatically to the ART when it begins operations. Applicants who have submitted their cases to the AAT do not need to reapply. Decisions finalised by the AAT will remain unaffected and will not be reconsidered by the ART. 

 

Impact on pending cases 

The transition to the ART will not disrupt the proceedings of ongoing cases. The ART will inherit all pending cases from the AAT, ensuring continuity and consistency. This change is designed to minimise disruptions and maintain the integrity of the review process.
